These terms govern the hire of equipment and the supply of special effects services by Star Moments Limited, trading as Event Effects. Please read them alongside your written quotation, which together form the contract between us.
"We", "us" and "our" mean Star Moments Limited T/A Event Effects. "You" and "the Client" mean the person or business named on the quotation. "Equipment" means all machines, consumables, cabling and ancillary items supplied by us. "Event" means the date, venue and times set out in the quotation.
A booking is confirmed only when we have received your signed acceptance of the quotation and the deposit stated on it. Until both are received, the date remains available to other clients. Held dates not confirmed within seven days may be released without further notice.
The balance is payable in cleared funds no later than fourteen days before the Event unless we have agreed different terms in writing. Prices shown on our website are indicative "from" prices; the price for your Event is the one stated on your quotation. Late payment may result in the booking being treated as cancelled under clause 4.
You may request a change of date or scope at any time and we will accommodate it where we reasonably can; a revised quotation will be issued where the change affects cost. If you cancel:
You are responsible for obtaining the venue's permission for the effects booked and for telling us of any restriction, curfew or condition the venue imposes. You must provide safe and unobstructed access for loading, a suitable level surface, and a suitable power supply. Where we are prevented from operating by the venue, by an unsafe site, or by conditions not disclosed to us in advance, the full price remains payable.
Operated Equipment is used only by our trained technicians, whose instructions on exclusion zones, positioning and timing are final and given in the interests of safety. We may reduce, delay or refuse a cue where we consider it unsafe, including where guests, staff or decor encroach on a cleared area. No refund arises from a cue withheld on safety grounds.
Where Equipment is supplied on a dry hire basis, you accept full responsibility for its safe use, for the competence of the persons operating it, for compliance with the venue's requirements, and for its safe keeping from collection or delivery until return. Equipment must be returned in the condition supplied, complete with all cabling and cases. You must not modify Equipment, use it outdoors in adverse weather, or use consumables other than those we supply.
You are liable for loss of or damage to Equipment while it is in your possession or on site under your control, other than fair wear and tear or a fault arising from our own servicing. We will charge the reasonable cost of repair or, where Equipment cannot be economically repaired, its replacement value.
We hold public liability insurance of £10,000,000 and will supply a certificate and event-specific risk assessment and method statement on request. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited. Subject to that, our total liability arising out of a booking is limited to the price paid for it, and we are not liable for indirect or consequential loss, including loss of profit, loss of goodwill, or the cost of re-staging an event.
Neither party is in breach of contract because of an event beyond its reasonable control, including severe weather, road closure, fire, flood, power failure, industrial action, epidemic, or an act or restriction of a public authority. Where we cannot attend for such a reason we will offer an alternative date or a refund of sums paid in respect of the affected services.
We may photograph or film our own Equipment in operation for our portfolio. We will not publish images in which guests are identifiable without your consent, and we will remove any image at your written request.
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Nothing here affects the statutory rights of a client contracting as a consumer.
